A limited licence
—often called a “work licence”—permits someone who is disqualified or suspended to drive under strict conditions. Typically, this licence is granted for work-related travel or essential personal obligations, allowing you to continue earning an income and supporting your family.
Am I Eligible for a Limited Licence?
Not everyone qualifies, so we evaluate three primary factors:
1. Gateway Conditions
You must meet at least one of these requirements:
-
Extreme Hardship: Would you lose your job, income, or be at risk of losing your home without a limited licence? General inconvenience (e.g., difficulty running errands) isn’t enough. However, most clients do meet the threshold of “extreme hardship.”
-
Undue Hardship to Others: Would an employer, business, or family member suffer significant financial strain if you can’t drive? We have secured limited licences for clients who need to transport children, support family members, or maintain a business.
2.Public Safety Concerns
The Police will assess your risk level based on past driving history, convictions, and how recent they were. I’ll work closely with the Police to address any concerns and demonstrate why it’s safe for you to drive under limited conditions.
3. Other Eligibility Factors
-
Past disqualifications or suspensions
-
Alcohol interlock licence requirements
-
Prior driving convictions
-
Driving while disqualified or breaching a prior limited licence
If you’re unsure about any of these requirements, get in touch. We’ll discuss your circumstances and give you an honest assessment.
What Happens Next If I’m Eligible?
Once we confirm your eligibility:
-
Custom Application: We’ll prepare a personalized limited licence application that fits your specific driving needs, whether it’s for commuting to work, supporting family members, or other essential errands.
-
All Documents & Filing: Simply provide your personal details, and we’ll handle drafting the legal documents, filing them with the court, and communicating with the Police.
-
Court Representation: I’ll appear in court on your behalf to present your case. My experience in Police Prosecutions allows me to address any objections effectively.
-
Fast Turnaround: Every situation differs, but we’ve helped clients get back on the road in just a few days—or even on the same day in exceptional cases.
The 28-Day Stand-Down Rule
For serious traffic offences like drink driving, there’s a mandatory 28-day stand-down before applying for a limited licence. If your offence carries a disqualification of six months or more, you’ll need to wait out these 28 days first.
No Stand-Down for Some Offences
Good news: If you’ve been suspended for excess demerit points, disqualified for careless driving, or charged with “boy-racer” offences (like sustained loss of traction or street racing), you don’t need to wait 28 days. You can apply for a limited licence immediately.
Demerit Point Suspensions
If you think you’ll hit the 100-point limit within two years and receive a suspension notice, call us right away. We can prepare your limited licence application in advance so you’re ready to file the moment you receive notice. Contrary to popular belief, there’s no one-month waiting period for demerit suspensions. In some cases, clients are back driving within days—sometimes even the same day!
Section 94: Community Work Instead of Disqualification
Under Section 94, the court may allow community work as an alternative to disqualification. I fought in 2004 to preserve this option, and it has saved countless jobs, homes, and businesses. If you want to explore serving community work instead of facing disqualification, reach out to us. I have extensive experience guiding clients through this process and assessing whether Section 94 is a viable option.
